1. Acceptance of Terms
Welcome to Pistackio, owned and operated by Cosentini Alessandro ("we," "us," or "our"). By accessing or using our website and services, you agree to be bound by these Terms and Conditions. If you do not agree, do not use our services.
2. Services
Pistackio provides AI-powered receptionist and automation services for HVAC businesses in the United States, including but not limited to:
- 24/7 automated inbound call handling and lead qualification
- Automated job booking and calendar integration
- Automated SMS and email follow-up campaigns
- CRM setup and management via GoHighLevel
- Digital marketing strategy and campaign management
Specific terms of service, pricing, and deliverables will be outlined in separate agreements for individual clients.
3. The Pilot Program
We offer a performance-based pilot program under the following conditions:
- No upfront setup fee is charged during the pilot period
- The pilot period concludes once our system has booked 5 confirmed jobs for your business, at which point billing begins
- A video testimonial may be required upon completion of the pilot as outlined in the individual service agreement
- Voice usage during the pilot is billed separately per minute at the rate outlined in your service agreement
- Pistackio reserves the right to accept or decline pilot applications at its sole discretion
4. User Obligations
- You must be at least 18 years old to use our services
- You must be an authorized representative of the HVAC business enrolling in the program
- You agree to provide accurate and complete information during onboarding and throughout the service relationship
- You are responsible for ensuring call forwarding is properly configured on your business line as instructed by our team
- You agree not to misuse the system or use it for any unlawful purpose
5. Payment Terms
- No payment is due until the pilot threshold (5 booked jobs) has been reached
- After the pilot, monthly subscription fees are due as outlined in your service agreement
- Voice usage is billed separately per minute across all tiers
- All fees are non-refundable unless otherwise stated in the service agreement
- Late payments may result in suspension or termination of services
- Plans are month to month with no long-term contract unless otherwise agreed in writing
6. Territory Exclusivity
We offer territorial exclusivity to our clients on a first-come, first-served basis. Once we are working with an HVAC business in a given service area, we will not onboard a competing HVAC business in the same area during the active service relationship. Territorial exclusivity is defined by the service area outlined in your individual agreement and does not constitute a legal monopoly or geographic restriction beyond our internal client policy.
7. Intellectual Property
- All content, trademarks, service marks, and logos on our site and landing pages are the property of Pistackio or its licensors
- Call recordings and transcripts generated through our system remain the property of Pistackio but are made accessible to the client for review purposes
- You agree not to reproduce, distribute, or create derivative works from any of our content without explicit written permission
8. Privacy
Your use of our services is subject to our Privacy Policy. By using our services, you consent to the collection and use of your information as outlined in that policy.
9. Limitation of Liability
- Pistackio is not liable for any direct, indirect, incidental, or consequential damages arising from your use of our services
- We do not guarantee a specific number of bookings, leads, or revenue outcomes beyond the pilot model described above
- We are not responsible for technical failures caused by third-party platforms including but not limited to GoHighLevel, Retell AI, or your phone carrier
10. Termination
Either party may terminate the service relationship with written notice. We reserve the right to suspend or terminate access to our services at our sole discretion for conduct that violates these Terms or is harmful to other clients or our business operations.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Italy. Any disputes arising from these Terms or your use of our services will be resolved in the courts of Italy.
